TERMS OF USE (DSA)

These Terms of Use (or “Terms”) govern your use of SafeSize service (the “Service”), outlined below. Please read these Terms carefully before you access the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of these Terms, then please do not access the Service. 

When the Terms mention “we,” “us,” or “our,” they refer to the company SafeSize Greece Single-Member S.A.” and/or any other affiliated companies that provides you with the SafeSize Service. 

1. Use of the SafeSize Service 

The SafeSize Service is a shoe recommendation solution based on your unique 3D foot profile and feet measurements. The SafeSize Service includes our devices including associated software, applications, products, and services. The service provider of the Service is SafeSize and/or the retail store where you make use of the SafeSize scanner. 

When using our 3D solution including our Digital Sales Assistant (“DSA”), an integrated camera is used. The said camera functions solely to detect the presence or movement of a person near the device in real time, for the limited purpose of activating interactive content, such as the avatar assistant and on-screen guidance. No personal data is collected or processed for the purpose of identifying individuals, and no images or video recordings are stored. The camera functionality does not record, store, transmit, or monitor images or video footage, and no person reviews or observes any live feed. The system does not perform facial recognition, biometric identification, identity tracking, profiling, or monitoring of individuals over time. No images, videos, or metadata are retained, and no information is used to identify any individual. Any motion or proximity detection is performed instantly and transiently in volatile memory only, without retention or reconstruction capability. 

Always follow the guidelines and instructions displayed on the scanner’s screen and provided by the sales staff. 

If you are under the age of 18 or if you have limited or no legal capacity, you may still use our Service but prior to using you are asked to get the consent of your parent or guardian in accordance with applicable law 

The SafeSize Service is not intended to diagnose, treat, cure, or prevent any disease. If you have any medical condition, please consult your doctor. The SafeSize Service will provide you with shoe recommendation advice aiming at always providing helpful and accurate information; however, we make no representation, warranty or endorsement of any kind about the information provided through the Service as this relates to your perception or personal preferences. Thus, if you rely on any SafeSize Service, you do so solely at your own risk. 

You must not use the Service in any way that causes, or may cause, damage to the Service or any third party nor in any way that is unlawful, illegal, fraudulent, or harmful. 

We are not responsible for the accuracy, reliability, availability, effectiveness, or correct use of information you receive through the SafeSize Service. SafeSize Content and Service may change from time to time or vary by geographic location. 

You may file any complaints for the Service with the service provider. 

2. Privacy

Some of the features of the SafeSize Service send or receive personal data or other information when using those features. For more information about how we use your personal data and our data practices, please read our Privacy Notice. 

3. Intellectual Property

The entire content of the Service, including but not limited to, texts, graphics, images, photographs, etc. (hereinafter the “Content“), constitutes intellectual property of SafeSize and is protected by applicable national, EU and international law, excluding the expressly recognised rights of third parties. 

Consequently, it is expressly prohibited in any way to copy, reproduce, use, republish, store, sell, transfer, modify or in general process the Content, in whole or in part, without the prior written consent/permission of SafeSize. SafeSize reserves all copyright in respect to the Content and copies created thereunder. 

SafeSize Content, the SafeSize Service, and its underlying technology are protected by copyright, trademark, patent, intellectual property, and other applicable laws. SafeSize reserves all rights not expressly set forth in these Terms. 

4. Account 

Full use of the SafeSize Service may require that you create an account by providing us with information such as your full name and a valid email address, as well as a strong password. You are responsible for all activity that occurs in association with your account. SafeSize is not liable for any loss or damages caused by your failure to maintain the confidentiality of your account credentials. Please contact us immediately if you discover or suspect any security breach related to the SafeSize Service or your account. 

5. Our Rights 

We reserve the right (but are not required) to remove or disable access to the SafeSize Service or any SafeSize Content at any time and without notice, and at our sole discretion, if we determine that your use of the SafeSize Service is in violation of these Terms. We have the right to investigate violations of these Terms and any conduct that affects the SafeSize Service, and in response may take any action we may deem appropriate. 

6. Changes to the Service 

SafeSize may change or discontinue, temporarily or permanently, any feature, component, or content of the Service at any time without notice. SafeSize is not liable to you or to any third party for any modification, suspension, or discontinuance of any feature, component, or content of the Service. We reserve the right to determine the timing and content of software updates, without prior notice to you. 

7. Termination 

We reserve the right to suspend or deactivate your account or your access to certain aspects or all of the SafeSize Service, or to terminate these Terms, at our sole discretion, at any time and without notice or liability to you. Upon any such suspension, deactivation, or termination, we may delete or remove your content and other information related to your account. You may close your account at any time by contacting customer support. Upon any termination of these Terms or suspension, termination, or discontinuation of the Service or your account, the following provisions of these Terms will survive: 7, 8, 9, 10, 11, 12. 

8. Disclaimer 

THE SAFESIZE SERVICE AND CONTENT ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We make no warranty that the Service or Content will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of the Service or any part of the Content. 

9. Indemnification 

You will indemnify, defend and hold harmless, and shall keep indemnified SafeSize and its respective officers, directors, employees, or representatives (and all successors and assigns of any of the foregoing) from and against any and all liabilities, damages, losses, costs and expenses (including legal expenses and amounts reasonably paid in settlement of legal claims) arising out of or in any way connected with (i) your access to or use of the Service, (ii) your breach or alleged breach of any warranties made by you hereunder or your violation of any other provision of these Terms, or (iii) your violation of any law. SafeSize reserves the right, at its own expense, to assume the exclusive defence and control of such disputes, and in any event you will cooperate with SafeSize in asserting any available defences. 

10. Limitation of Liability 

SAFESIZE NOR ITS DIRECTORS, EMPLOYEES, CONTRACTORS OR AFFILIATES SHALL IN NO CASE BE LIABLE IN RESPECT OF ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICE.  

If your jurisdiction does not allow the exclusion or limitation of liability for consequential or incidental damages, then the above limitation may not apply to you. 

11. Applicable Law and Dispute Resolution 

These Terms are governed by the laws of Greece. All disputes arising between us in relation to the Service shall be settled by the competent court in Athens, Greece. 

12. Miscellaneous 

Except as otherwise stated herein, these Terms constitute the entire and exclusive understanding and agreement between SafeSize and you regarding the Service, and these Terms supersede and replace any and all prior oral or written understandings or agreements between SafeSize and you regarding the Service and the Content. 

If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect. 

SafeSize’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of SafeSize. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
